Apple Photos faces $32.5 billion class action lawsuit over alleged illegal collection of facial data
A class action lawsuit against Apple's Photos app in Illinois, US, has been approved to proceed, with claims totaling up to $32.5 billion. The lawsuit alleges the app collects biometric data without informed consent: it uses facial recognition to scan people in photos, generates "facial features," and syncs data via iCloud.
Under Illinois' Biometric Information Privacy Act, about 6.5 million consumers are affected. Apple tried to dismiss the lawsuit, arguing the process isn't a biometric identifier and that safeguards exist. In June, a judge granted class action status, and on June 30, the Seventh Circuit rejected Apple's appeal.
